1. What this service is

TaxBackAir is an administrative service that prepares, submits and follows up claims for refunds of taxes and charges included in a flight the passenger did not use. We act as an intermediary between the passenger and the airline. We are not a law firm and we do not provide legal advice.

2. The free eligibility check

Before any payment, we check the airline's published refund policy against the flight details you give us and tell you one of the following: that your flight appears eligible; that we need more information; that a person needs to review your booking; that we do not recommend claiming; or that a claim is not possible. Only the first outcome leads to a payment. The check costs nothing in every case.

3. What we charge

Our fee is 2,99 € per accepted claim. It is a flat fee. We do not take any percentage of what the airline refunds — you receive 100% of that amount, paid by the airline directly to you.

We only charge when our check has accepted your case. We do not charge for cases we decline, cases under review, or cases we advise you not to pursue.

4. Our guarantee

If we accept your claim and later find that it was not eligible under the airline conditions that applied at the moment we accepted it, we refund your fee in full.

We cannot and do not guarantee that the airline will approve a refund. That decision belongs to the airline. What we guarantee is that we will not charge you for a claim we should not have accepted.

5. Your right of withdrawal

As a consumer you normally have 14 days to withdraw from a distance contract. Because this service is performed immediately, we ask you to expressly request that we begin before that period ends, and to acknowledge that you lose the right of withdrawal once the claim has been submitted to the airline.

If you have asked us to begin but we have not yet submitted your claim, you may still withdraw and we will refund the fee in proportion to the work done. If you have not given that acknowledgement, your full 14-day right applies.

6. What we need from you

  • Accurate flight and passenger information.
  • Authentic documentation. We will not submit a claim based on documents we have reason to believe are not genuine.
  • Confirmation that you did not travel on the flight concerned.
  • To be reachable while the claim is open.

7. Authority to act

By submitting a claim you authorise us to contact the airline on your behalf in relation to that specific claim. That authority is limited to requesting the refund of unused taxes and charges. We will never use your booking reference to cancel, change, rebook or otherwise modify your reservation.

Some airlines require the claim to come from the passenger, the person who paid, or the travel agent. Where that applies, we will tell you and, if necessary, ask you to sign a specific authorisation or submit the claim yourself.

8. How the refund reaches you

The airline refunds you directly, normally to the payment method used for the original booking. We do not receive, hold or pass on refunded money at any point.

9. Limits of our responsibility

We are not responsible for:

  • an airline's decision to refuse or reduce a refund;
  • how long an airline takes to respond;
  • changes an airline makes to its policies after we accepted your case;
  • administration charges the airline applies, where we disclosed them or could not reasonably have known of them.

Nothing here limits liability that cannot be limited by law, including liability for death, personal injury, fraud, or our own gross negligence.

10. Rules and versions

Each accepted case records the exact airline policy we relied on, including where we read it and when we last checked it. Your case is assessed against that recorded version. A later change to an airline's policy does not retroactively change a decision we already made.

11. Complaints and dispute resolution

Write to us first at info@taxbackair.com. If we cannot resolve the matter, EU consumers may use the European Commission's online dispute resolution platform or their national consumer body.

12. Governing law

These terms are governed by the law of US. As a consumer you keep the protection of the mandatory rules of your country of residence, and you may bring proceedings in your own courts.

13. Changes

We may update these terms. Each version is dated and numbered. The version that applies to your claim is the one recorded at the moment you paid, not the one shown here today.
